Traces of Catastrophe: Can Disaster Inspire (Copyright) Creation?

Catastrophes, both natural and man-made, leave lasting marks. But what happens when these events inspire creative works? Where does copyright law stand when art, literature, or music attempts to capture the essence – or even the direct documentation – of a disaster?

It's a complex landscape. Can you copyright the trauma someone else experienced and shared? Documenting a disaster, even creatively, doesn’t necessarily grant you exclusive rights to the event itself. Copyright protects your specific expression, not the underlying facts or the tragedy itself.

However, artistic interpretation based on survivor accounts, photographs, or videos could potentially be protected. Determining originality becomes paramount. Did you simply replicate existing material, or did you transform it into something new and unique? The 'traces of catastrophe' might linger in your work, but it’s your individual artistic contribution that copyright law protects.
